Today began the cross examination of John Freshwater after the questioning of the first witness, Ricky Warren.  The progress in the cross examination was painfully slow as John, at times, had difficulty answering questions with one of 3 options:  Yes, No or I don't recall/remember.   At one point, the referee even indicated to John that the question seemed to be a simple one.

Incongruities between John's earlier testimony, testimony in the Federal Court Case and recent testimony were brought up by Millstone today.

Some of the incongruities focused on the use of the Tesla Coil and how or whether or not he used it on students and himself, whether he led prayer in FCA based on his responses to HR On-Call questions (John had recorded and transcribed the interview in its entirety), whether or not he had referred students to Answers in Genesis (AIG) as he had answered that question multiple ways

John stated that he had "no opinion" (with regard to his personal beliefs) about homosexuality and had "no opinion" about whether or not he felt the Bible said it was a sin. 

Millstone went through the transcribed HR On-Call interview.  In it John had agreed to provide HR On-Call with a copy of the audio tape within 48 hours.  John did not comply with this.  It was stated that John's attorney would provide a collective summary of John's position for HR On-Call.  This was never done.  John completed 15 affidavits with his attorney by May 25th which addressed more specifically components of the investigation, none of which John or his attorney ever gave to HR On-Call, even though their report wasn't completed until sometime in June.  These affidavits made by John & Hamilton were also never given to John's Federal court case attorney.   John has said several times that he didn't get a 2nd interview with HR On-Call.  That was addressed as well.  There was nothing during the 1st interview that stated he would be entitled to a second interview and John never requested one nor tried to give HR On-Call any of the information that he wanted to have included in the investigation. 

It was also brought up that John has never filed a grievance over the HR On-Call report, request to remove the Bible or any other aspect of the investigation or charges against him. 

I'm sure that Panda's Thumb will have a much better summary of what occurred today.  These are just some of the highlights of the day.

It's relevant because one of the allegations in the investigation is that Freshwater told students that an article describing research on the genetics of homosexuality must be false because the Bible says homosexuality is a sin, and it therefore must be a choice and not genetically influenced.  So it was an appropriate series of questions for the hearing.

I doubt it'll be much better, if any -- that's a good summary, and it was a thin day given Freshwater's style of answering.

That was part of the evidence adduced to support the allegation that Freshwater was contacting speakers for FCA rather than students.  There are two questions associated with the email that was under examination: (1) did Jordan Freshwater, John's daughter, send the email to Warren out of her father's account?  If so, that's OK--she was part of the leadership of FCA then.  (2)  Warren thought the email may have been altered, meaning that what was introduced in evidence at the hearing is not what was actually sent and received between Jordan/John and Warren.  That's a serious allegation.

Later in the hearing today when presented with another email supposed to be from Freshwater to White regarding a copy of the tape Freshwater made of the investigators' interview with Freshwater, John said he couldn't identify it as what he sent, alluding to the possibility of forgery and his new-found cynicism about documents.
